These terms and conditions pertain to an individual and/or company's
participation in the Pedigree Online Affiliate program.
Joining the Program
By filling out the program application form you will automatically become a
Pedigree Online affiliate. Your participation in the program is solely for this purpose: to legally advertise the
Pedigree Online site and productss and receive a commission based on products purchased by your referral individuals.
Revocation of Affiliate Status
Your affiliate application and status in the program may be suspended or terminated for
any of the following reasons: Inappropriate advertisements (False claims, misleading
hyperlinks) Inappropriate web site (porn) Advertising on sites containing/promoting illegal activities Violation of intellectual property rights (copying
Pedigree Online material)
Linking to Pedigree Online
You may use graphic and text links both on your website and in emails. The site may
also be advertised "offline" in classified ads, magazines, and newspapers. You may use
the graphics and text provided to you by Pedigree Online, or you may create your
own as long as they are deemed appropriate according to the conditions in 2.
Affiliate Commissions
You will be paid referral fees for every Pedigree Online "product" purchase via online
credit card orders. You will receive a 5% commission on all purchases generated by
your referrals to this website. You will NOT receive affiliate commission on products
bought by yourself or your company.
Affiliate commissions are revenues derived by us from our sales of Qualifying Products, excluding costs for shipping,
handling, taxes, service charges, credit card processing fees, and bad debt.
Affiliate commissions will be paid out monthly with a no minimum value to be
reached.
Terms of the agreement
These terms will begin upon your signup with the affiliate program and will end when
either you or Pedigree Online terminates your affiliate status. The terms of this
agreement may be modified at any time by Pedigree Online. If any modification is
unacceptable to you, your only choice is to terminate your affiliate status. Your
continuing participation in the program will constitute your acceptance of any change.
Policies and Pricing
Customers who buy products through this Program will be deemed to be customers of
Pedigree Online. Accordingly, all Pedigree Online rules, policies, and operating procedures concerning customer orders, customer service, and product
sales will apply to those customers. We may change our policies and operating procedures at any time. For
example, we will determine the prices to be charged for products sold under this Program in accordance with our
own pricing policies. Product prices and availability may vary from time to time. Because price changes may affect
Products that you already have listed on your site, you may not include price information in your Product
descriptions. We will use commercially reasonable efforts to present accurate information, but we cannot guarantee
the availability or price of any particular product.
Liability
Pedigree Online will not be liable for indirect or accidental damages (loss of revenue,
commissions) due to affiliate tracking failures, loss of database files, and any results of
"intents of harm" to the program. Pedigree Online does not make any expressed or
implied warranties with respect to the affiliate program and/or products sold at this site.
We make no claim that the operation of Pedigree Online will be error-free and will not
be liable for any interruptions or errors.
Disclaimers
We make no express or implied warranties or representations with respect to the Program or any products sold
through the Program (including, without limitation, warranties of fitness, merchantability,
noninfringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no
representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the
consequences of any interruptions or errors.
Independent Investigation
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND CONDITIONS. YOU
UNDERSTAND THAT WE MAY AT ANY TIME (DIRECTLY OR INDIRECTLY) SOLICIT CUSTOMER REFERRALS ON TERMS
THAT MAY DIFFER FROM THOSE CONTAINED IN THIS AGREEMENT OR OPERATE WEB SITES THAT ARE SIMILAR TO
OR COMPETE WITH YOUR WEB SITE. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PARTICIPATING
IN THE PROGRAM AND ARE NOT RELYING ON ANY REPRESENTATION, GUARANTEE, OR STATEMENT OTHER THAN AS
SET FORTH IN THIS AGREEMENT.
Miscellaneous
This Agreement will be governed by the laws of the United States and the state of
California, without reference
to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state
courts located in San Diego, California, and you consent irrevocably to the jurisdiction of such courts. You may not
assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that
restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and
their respective successors and assigns. Our failure to enforce your strict performance of any provision of this
Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of
this Agreement.
